Texas Jail Medical Neglect

In Texas city and county jails, jail inmates have a right, pursuant to the 14th Amendment to the United States Constitution, to receive reasonable medical care.  A jail must have in place appropriate policies to assure that medical care is provided. 

This constitutional right also requires Texas police officers and certain other persons to individually provide such care.  If an officer is deliberately indifferent to or acts in an objectively unreasonable manner regarding a jail inmate’s healthcare needs, the officer and others, including the city or county operating the jail, can be liable for constitutional rights violations under 42 U.S.C. § 1983. 

A Texas inmate might suffer paralysis, a brain injury, a stroke, a heart attack, or even death if a jail or holding facility fails to provide appropriate healthcare.  If actionable, damages can be recovered.
