Texas Excessive Force by Police

The United States Constitution’s 4th Amendment, 8th Amendment, and/or 14th Amendment, depending upon the situation and the classification of an inmate, provides protection from excessive force used by Texas police officers.  There are a number of factors which the United States Supreme Court has determined must be reviewed to determine whether an excessive force violation occurs. 

Excessive force claims also can arise as a result of an arrest, when someone is beaten, shot, and/or shocked with an electric weapon.  Excessive force claims against Texas peace officers can also arise after arrest, both during book-in and while being held at a local city or county jail.  Video evidence, whether dash cam video, body cam video, and/or jail video, can assist greatly in determining whether a violation has occurred.
